Little brother thrown out of class can I fight back?

Im furious!

Basically my little brother came to me today telling me they'd kicked him out of his Biology class because: "there is no space", even though he was enrolled in it and even attended some classes. The Deputy simply explained that there are too many students in that class so they just "chose" my brother and another pupil to kick out. Surely this isnt right!

My brother had some problems last year and couldnt attend the classes properly and consequently failed, and is repeating. So is the other boy, but there are other repeating students still in the class, as well as some fast track pupils who are two years younger than the rest of the class.

I am his guardian with all school matters, and will be heading down there tomorrow or Friday, what can I do? What should I say?

Any help would be appreciated!
